When marketing a cosmetic product on the Italian market, companies must ensure compliance with European harmonized law as well as specific national provisions. Cosmetic Products are governed mainly by Regulation (EC) No. 1223/2009, also known as “Cosmetic Product Regulation” (CPR). This Regulation provides a harmonized definition of cosmetic product as well as safety provisions, ingredient regulations, labelling and advertising requirements, and the duties of the Responsible Person (RP). The webinar will discuss the interplay between the CPR and national laws, highlighting specific regulations in Italy, such as Legislative Decree No. 204/2015 and Ministerial Decree of September 27th, 2018. It will also cover Regulation (EU) No. 655/2013 on cosmetic product claims and the technical guidance provided by the European Commission. We will further explore the REACH Regulation (Reg. (EC) No. 1907/2006), which governs the registration, evaluation, authorization, and restriction of chemicals, and its implications for cosmetic ingredients. In addition, the webinar will illustrate the roles of manufacturers, importers, and downstream users under REACH, and the classification, labelling, and packaging (CLP) requirements for hazardous substances. Packaging regulations, including Directive 94/62/EC on packaging and packaging waste and Legislative Decree 116/2020 on environmental labelling, will also be addressed. Finally, we will discuss the notification process for cosmetic products via the Cosmetic Product Notification Portal (CPNP), market surveillance, and the requirements for exporting cosmetic product to the European Union with a focus on Italy.
