Imprisonment for unauthorised and unjustified access to confidential personal data

The Second Criminal Chamber of the Spanish Supreme Court has recently ruled in its judgment 178/2021 on a crime of discovery of secrets, typified in Articles 197 and 198, the latter Article for the aggravating circumstance of a public official, of the Spanish Penal Code. 

Specifically, the Court charged an offence of "unauthorised and unjustified (...) access to confidential personal data" to a nurse who consulted personal data of a patient in which was not in charge.

It is necessary to mention the legal requirements to consummate the offence: there must be harm to the owner of the personal data, which the Court considers to be subsumed by the fact that the personal data is classified as sensitive. It is for this reason that the same offence carried out against non-sensitive personal data requires the accreditation of the concurrence of harm.

This ruling sentences the condemned to two and a half years of imprisonment and six years' professional disqualification from practising her profession.
