The boomerang effect of legitimate interest in data processing for marketing purposes

​Tennis in the sights of the authorities: the Dutch Privacy Authority sanctions the national tennis association for unlawful disclosure of its members' data to sponsors.

On 3 March 2020, the Dutch Data Protection Authority (the Autoriteit Persoonsgegevens) imposed a fine of €525,000 on the national tennis association, KNLTB.

The fine follows the Authority's investigation of the unlawful disclosure of data of about 350,000 members to two sponsors. In particular, according to the Dutch Authority, the legitimate interest is the cornerstone of the illicit nature of data communication. KNLTB has in fact taken advantage of such legal basis, thus consciously avoiding to collect the consent of its members to the processing of their personal data for marketing purposes. 

Though KNLTB has appealed against the decision, and a reply from the Authority is expected, the measure is interesting as it confirms the general reluctance of European national data protection authorities to broadly accept the use of legitimate interest as a valid legal basis for the processing of data for commercial purposes.
